The tornado cash case is going to likely set the precedent for what “money transmitting” means for purposes of bitcoin. The case will mostly hinge on how “transfer” should be defined within the meaning of Section 1960. As these screenshots show, the government argues that it means “by any and all means” and that “control” is not a prerequisite to be considered a transferor. They use examples like a USB cable being a transferor of data and a frying pan transferring heat from a stove. By this logic, anyone operating hardware or software which Bitcoin runs through could be deemed a money transmitting business. However, this is obviously overly broad. My guess is, if the judge has common sense, he will see that a line needs to be drawn somewhere. The easiest line to draw is by making control a prerequisite. Otherwise the governments reasoning opens up liability to almost any tech company providing software or hardware. The line of reasoning is simple: Are dell and Microsoft money transmitting businesses because their laptops and software enable you to send money to someone in e-commerce? No. What about your ISP whose internet connection enables the transfer of data to complete an internet purchase? No. Why? Because they aren’t exercising control over the transaction, they are just providing the rails that make it possible - and have no further involvement.

I’m ashamed to admit I haven’t run my own node but I’m now going to. What’s the best way to go about it? Raspi? Cheap laptop? Any tips appreciated!

As I said yesterday, samourai is just the first domino to fall. Non-KYC exchanges are next. After that, new 2025 IRS regs and form 1099-DA will seek to acquire identifying info on *every single transaction* made by *every single wallet*. This is a coordinated effort by all agencies to eliminate privacy in Bitcoin. View quoted note →

Imagine the hammer that would’ve been dropped on Satoshi by the government if he wasn’t able to remain completely anonymous.

Tip for all the European plebs who just got access to strike - when you’re withdrawing to cold storage, always do the free 24 hour withdrawal. It does take a while but I’ve never had to actually wait 24 hours.

My favorite line parroted in the MSM articles about the halving is when they call it a “much anticipated software update”

Now that the halving is over, back to regularly scheduled programming of fighting govt overreach: The IRS released a draft of form 1099-DA. A 1099 form that is specifically designed for digital assets. Things to note: (1) one of the options for broker type is “unhosted wallet providers”; (2) they ask for the specific tx ID; (3) they ask for the wallet address; (4) there’s a box for wash sales - Bitcoin isn’t subject to wash sale regulations…yet; (5) it asks date and time sold or DISPOSED of, which I take to mean exchanges need to report all withdrawals to cold storage - AFAIK there’s currently no way the IRS differentiates between a taxable transfer and a self-transfer, and exchanges typically don’t report withdrawals to cold storage as taxable events (correct me if I’m wrong). It pretty much seems like they want to know of every single transaction. A lot of this will obviously be challenging for the IRS to track unless everyone self-reports all their transactions (lol). But it’s concerning how much info they’re trying to collect. This form starts for tax year 2025 with filing in 2026, and comments are still open. https://www.irs.gov/pub/irs-dft/f1099da--dft.pdf

Every time I have made a lump sum stack on top of my dca in the past month, bitcoin has tanked the following day. At this rate I may personally be able to push us back down to $30k. You’re welcome.

I spent only10 days in Italy and could notice a massive difference in the way my body and mind felt from eating foods without a billion additives. The US food supply is poisoned and I am not looking forward to going back to it.
