Third Circuit Says Challenge Against New Jersey's Nuisance Law Can Go Forward

New Jersey promised it wouldn't target lawful gun businesses, then sued six of them. The Third Circuit just called the state on it.

The NewJersey AG will now have to defend the state's so-called "public nuisance" law which it has used to bring enforcement against gun manufacturers and distributors no fewer than six times. Idaho Becomes Third State to Introduce Legislation That Could Legalize Machine Guns

Idaho is the third state to introduce legislation legalizing machine guns. The bill would take effect if the federal ban is repealed or struck down.

Earlier this year, West Virginia, Kentucky, and Idaho all passed measures that effectively created a mechanism to either transfer machine guns from law enforcement to qualified citizens, or legalized the possession, manufacture, and sale of machine guns under certain conditions. With the respective legislative sessions concluded for the year, all three bills are dead. But we could see a repeat of this next year on a larger scale, especially as challenges against the NFA ramp up.
