Chinese prosecutors have applied to confiscate approximately 61,896 Bitcoin along with other assets seized by UK authorities in the investment fraud case involving Qian Zhimin. The Second Intermediate Peopleโs Court of Tianjin announced that the application has been accepted for review.
According to prosecutorial documents, the company controlled by Qian, Tianjin Lantian Gerui, raised more than 40.38 billion yuan, or about $5.7 billion, through fake investment products between April 2014 and August 2017. More than 102,000 investors suffered losses totaling around 19.98 billion yuan. Part of the funds was used to pay earlier investors and to purchase Bitcoin and other assets.
The application also covers Bitcoin Cash, Bitcoin Gold, Bitcoin SV, XRP, Dogecoin, cash, and jewelry. Prosecutors are seeking the recovery of criminal proceeds and any derived gains, while excluding the portion that must be returned to victims from state confiscation. The application is not yet a final ruling.
Separately, the High Court of England and Wales ruled on October 12 that Chinese law applies in determining the basis of ownership rights claimed by the victims. The decision, reported on October 13, has not determined the final owner of the Bitcoin. Victims still need to prove their claims, while the review process continues in the UK.
