Check the text of the #AML regulation “before and after”: you see that provisions which defended #crowdfunding efforts for civil society organisations and supported by the European Parliament in April 2023 were deleted during the #Trilogue. This unreasonable and disproportionate expansion, without any exceptions, in effect, devastates fundraising efforts for activists and NGOs like Open Dialogue Foundation. In times of crisis, such as natural disasters, military conflicts, like the latest in #Ukraine, or emergencies, crowdfunding becomes a rapid and effective means for civil society to gather resources. The proposed expansion of the AMLR to categorize all crowdfunding platforms as risky channels echoes existing de-risking practices that have already shown devastating impacts on vital humanitarian efforts. 2/5 image
On behalf of the BTC Coalition, we are recommending MEPs to vote AGAINST the #EU #AMLR proposal and urge you to join our call for three main reasons: 1. EU WILL DEVASTATE CROWDFUNDING FOR ACTIVISTS AND HUMANITARIAN NGOs NGOs barely receive funds to support human rights or humanitarian aid. #Crowdfunding, including the use of #Bitcoin  in self-hosted wallets, is the last resort. What is the EU doing? In the post-Trilogue AMLR draft, all possible crowdfunding platforms, including based on crypto-assets and serving humanitarian purposes, designated as intermediaries, are considered as high-risk ever-evolving Money Laundering and Terrorist Financing (ML/TF) channel. In practice this means fewer and fewer donations, because of: 🔻increased administrative & operational costs, 🔻reduction of the donor base due to invasive due diligence processes, 🔻reduced financial inclusion of smaller entities and projects that traditionally rely on crowdfunding. The AMLR does not take into account the broader negative impacts on society, resulting in the obstruction or even halting of social, entrepreneurial and humanitarian initiatives. 1/5 image
CALL ON EUROPEAN PARLIAMENT TO VOTE AGAINST EU AMLR PROPOSAL NOW! Tomorrow the European Parliament is going to vote on its latest #EU #AMLR proposal. Unfortunately, the Trilogue procedure led to the removal of all civil society recommendations, weakening the position of the only directly democratically-elected EU institution—the European Parliament. This has resulted in: 🔻 a considerable reduction of financial freedoms & increased financial exclusion; 🔻heightened risks of abuse of the AMRL, including the exposure of EU citizens and residents to the potential misuse of their financial data by authoritarian regimes. Additionally, as the EU sets global financial regulatory standards, the negative language in the AMLR about privacy payment tools, such as self-hosted wallets & mixers, could lead to restrictions on financial freedoms in third countries and increase the potential for financial repression by illiberal regimes. REGIMES' WAR AGAINST P2P BITCOIN CASH EXCHANGES HAS BEGUN Imagine you were born in one of the richest countries in the world, with an area as big as the entire territory of the European Union. All the wealth is in the hands of a narrow group of corrupt oligarchs, while the population of the country simply survives on food loans. This is what #Kazakhstan looks like today, where the regime is kept in place only through brutal repression and Putin's army, ready to crush peaceful protests at the first call of the Kazakh president. As soon as you dare to put a like under a post criticising the authorities or participate in a protest, you are declared an extremist, a terrorist, a threat to national security or a money launderer. The police will not only torture you to death after your arrest, they always take hostages of those you care about most. Your son or daughter may be kidnapped and killed to "make you come to your senses". Your only chance of escape is to get on EU or US politicians' political prisoner lists. Kazakhstan is very keen on international recognition, trade and these are the only leverages for the release of political prisoners. But let's look at another situation. You are not an activist. You're just a sympathiser and you've decided to donate to support the politically persecuted or support an opposition movement. 🔻What then? You'll be charged with „funding extremism” or „laundering money” in a secret court. You, your family members will all be financially excluded immediately. You can work informally for cash, but it is becoming increasingly difficult. In such situations as described above, p2p exchange of cash for #bitcoin becomes the only salvation for you, how to protect your resources from illegal searches by secret police, banal theft and in general safety, transfer of your value. 🔻But the party did not last long: Kazakhstan's regime decided to take the tool away from the financially excluded and criminalise p2p cash-to-cryptocurrency exchanges in line with FATF/G7 recommendations. Protecting such people as politically repressed is almost impossible for human rights defenders with this approach. This is one of the main factors why negative language towards bitcoin/p2p exchanges should not be allowed in the regulation of democracies. 🔻Kazakhstan primarily targeting those who use p2p transactions, mostly with cash for bitcoin and #USDT. On 12 March 2024, Kazakhstani media reported that a resident of Astana was imprisoned for 2 years and 6 months with confiscation of property for "illegal p2p-exchange of cash for cryptocurrency". 🔻Follow how fast was reaction of regime: on 4 March 2024, the Financial Monitoring Agency of Kazakhstan announced that it "observes the presence of illegal transactions of individuals with cryptocurrency (purchase, sale, payments for goods, works, services, transactions via P2P)". Already on 12 March, the first demonstrative "verdict" on conducting "illegal" p2p exchanges of cash for cryptocurrency was announced. 🔥Question to #Nostr: What solutions do you have to protect individuals doing #cash to bitcoin p2p exchanges in such countries? p.s. This is a photo of the family of a peaceful Kazakhstani man, 31-year-old Zasulan #Amangeldinov, a father of three. He is one of the victims of torture and mass shootings involving Russian troops in January 2022. The reason for his arrest and torture by pouring boiling water on him in the Almaty pre-trial detention centre is that he was a witness and victim of mass shootings. Zhasulan was financially excluded as a „suspected extremist”.
My 39. Enjoying the moments of my life: ❤️‍🔥 A moment of weakness: the hardest memories in my 15 years of human rights work are the meetings of families with released political prisoners. I thought that after having had over 100 such meetings, I could be less emotional. I can't. An image from my childhood of first losing hope from the lawlessness of the regime towards my family, and then the endless joy of being able to hug my brother, who was released after being kidnapped from the hospital, comes back to me every time. But every time you feel a wave of joy at the happiness in the eyes of family members in hugs with their loved ones, your pain disappear. You witness the steely hurt in the eyes, the facial expressions from reliving the nightmares of the political prisoners who were released. You see the love that sustained them and helped them through this journey. That moments move you forward and stimulate your work when others disbelieve that it’s possible. Everything is possible. 🧡A moment of strength: I remember vividly the losses, the experienced ups full of love and the painful downs on the way to 39 years. Our love, our feelings and beliefs are getting stronger when we experienced ups and downs, when we fight for our beloved. I remember the realisation of the moment, how life can be cut short in a matter of days. Everyone you love and everything you love can be shattered. What remains is the memory and the belief that you can overcome, you will love again. You used to say it to other politically repressed who had such experience, and than that moment came to you… you have to listen no matter how hard it was to say. ⚡️Importance of learning: You learn fast how important it is to live in the moment and how important it is to be able to first defeat your own consciousness and the minds of those around you, then the winning in the physical world is a matter of technique. Then comes the moment of power, not only yours but those who are with you in this struggle. 6 years later with this approach you can not only stop but defeat two of the three authoritarian regimes using the whole machinery of power against you and your family, your organisation. 🫶 How to fight back: Yep, it's possible. I have been able to walk this path because of my experience in defending the politically persecuted, friends, my brother who know how to share not only moments of joy but also how to hold a strike. Being all financially isolated, we were able to resist and defeat the attacks of the three regimes thanks to #bitcoin. #SatoshiNakomoto is unlikely to read this post, but that doesn't mean I want to give him a huge thank you. For being able to stand up, to save the lives of those for whom human rights are not just a set of derring-do phrases and "fresh regret". How do you feel at 39? We need to educate policy makers in democracies to use neutral language in legislation towards to #bitcoin #freedomtech instruments. We also need to educate judges. If we don’t do this, the first who are going to suffer are bitcoin developers, miners and end-users. I vividly remember the sense of despair I felt as a teenager and later being experienced human rights defender due to the political persecution of my family. I remember what it meant to me to receive the help and solidarity of perfect strangers to defend our rights. Over the course of the 14 years of the Open Dialogue Foundation’s work, I see myself in the eyes of the families of politically repressed individuals who are fighting for their loved ones, and I see their joy after the release of political prisoners. I deeply believe that supporting and defending people who peacefully oppose authoritarian regimes can help keep our fragile world a safe and comfortable place to live in. Entire generations have given their lives to the cause of human rights so that we can live today in safety, prosperity, comfort, and with a sense of rights and freedoms as stable as those in the United States or the European Union. But as soon as we forget the price and the need to protect our rights, regimes immediately take advantage of the situation. The ease with which your European bank account can become a weapon to attack, kidnap, and persecute all your loved ones is just one example. Two years ago financial system of Ukraine and democracies were paralyzed due to the Russian full invasion to Ukraine. Fundraising campaigns of pro-Ukrainian volunteers on GoFundMe, Partonate and other platforms, financial providers, banks were frozen or terminated with no justification. Lately we learned that our causes were associated with “risk/emergency activities” according to #FAFT recommendations. How we were able to deliver anyway humanitarian aid and especially hundreds pieces of protective equipment for our families and friends, journalists to #Kyiv and #Lwiw on the second day of the war? Thanks to the speed of #bitcoin. While the world was thinking should they act or wait we were getting support from bitcoin community/our families from abroad via bitcoin transactions. Today Ukrainians using bitcoin too, especially at the temporary occupied or under risk of occupation places. There is no other payment instruments. You can’t use also cash - it is dangerous to have Ukrainian currency with you at such places. I am forever grateful for that help and support 🫶🙏 image
Very good move and congratulations to Riot Blockchain for gathering coalition to file a lawsuit against discriminatory EIA survey! Good, that in the US there is strong #bitcoin community, defending #PoW #freedomtech. I wish to have such partnership in the EU… It is a clear example of difference between democracies and authoritarian states: you can fight back in democracy using institutions/separation of the powers. For this report we are in process of collecting testimonies both from bitcoiners and financially excluded activists, victims of weaponization of banking data. We should do it before the end of March and conduct 2 advocacy missions bringing activists and bitcoiners to Parliamentary Assembly of the Council of Europe.
