[2/7] The current SEC Chair just made the argument for putting it in writing. Paul Atkins, this week, on the CLARITY Act: the statute is "the way to future-proof" the rules. Without one, a future chair can walk them back with a memo. [3/7] The gap most people miss: Agency guidance can be erased overnight. New administration β†’ new chair β†’ new memo. Gone. A statute can't. It takes an act of Congress to undo an act of Congress.
