I think it's made worse when the state has virtually unlimited resources (stolen) and no consequences when they lose. I know we have a right to criminal defense, but it definitely isn't equal to the resources of the federal government. Maybe the founders should have included a prosecution resource cap.
I had this funny (maybe?) epiphany while studying for the bar, that if someone were to threaten to put you in a cage unless you signed a contract, it would be void because it was formed under duress, but when the government does it we call it a plead bargain.
