Everybody in the US is due legal rights based on the constitution, not the same rights as citizens but the courts have ruled many times that temporary visa holders in the US do have the right to legal due process and free speech.
The US political system prevents tyranny through a system of checks and balances between different branches of the government. The entire system was designed to prevent anybody executing king like powers in the executive. If i want rights for myself, especially the right to a day in court if iβm accused of violating the law, then i have to demand those rights be upheld for others.
