According to the PCC, the association stifled competition in Boracay’s diving sector by enforcing minimum “floor prices,” including P3,000 for Discover Scuba Diving sessions and P25,000 for Open Water certification courses. The group also prohibited freebies such as complimentary dives, meals, or photos for tourists, capped commissions for tour guides and hotels at 10 percent, and threatened violators with fines and business closure. While BBASS maintains that these rules were intended to protect livelihoods and ensure diver safety, the PCC emphasized that price-fixing arrangements are strictly prohibited under Philippine law and ultimately harm consumers by limiting choices and driving up costs. The Commission has reminded local government units (LGUs) to maintain an open and competitive environment for tourism activities.
