Watching how this unfolds. Supreme Court Case "Learning Resources, Inc. v. s Donald Trump (consolidated with V.O.S. Selections, Inc. v. United States) It could reshape the balance of power between the executive and legislative branches regarding: • Trade policy • Emergency declarations • Economic regulation without congressional oversight If the court sides with Trump, future presidents could use emergency powers to bypass Congress on major economic decisions. If it rules against him, it may rein in decades of expanding executive authority. Luckily, during oral arguments on November 5, 2025, justices from both conservative and liberal wings raised serious concerns: • Chief Justice John Roberts noted that imposing tariffs is “the imposition of taxes on Americans,” which is traditionally Congress’s power, not the presidents. • Justice Neil Gorsuch warned of a “one-way ratchet” toward unchecked executive power, calling it a shift away from the people’s elected representatives. • Justice Sonia Sotomayor emphasized that tariffs are essentially taxes, and the Constitution assigns that power to Congress. • Justice Amy Coney Barrett questioned the global scope of Trump’s tariffs, asking why countries like Spain and France were included.
