If it rules against him, it may rein in decades of expanding executive authority. Luckily, during oral arguments on November 5, 2025, justices from both conservative and liberal wings raised serious concerns: • Chief Justice John Roberts noted that imposing tariffs is “the imposition of taxes on Americans,” which is traditionally Congress’s power, not the presidents. • Justice Neil Gorsuch warned of a “one-way ratchet” toward unchecked executive power, calling it a shift away from the people’s elected representatives. • Justice Sonia Sotomayor emphasized that tariffs are essentially taxes, and the Constitution assigns that power to Congress. • Justice Amy Coney Barrett questioned the global scope of Trump’s tariffs, asking why countries like Spain and France were included.
