Invoke meaning do the process. It's not easy to get 60% of a state population in one place. The whole procedure or processes to the procedures of ballot is designed to be next to impossible for the public to invoke because if they could then the government has to adheer by law. But you are right they could break constitutional law how would the domino effect of that react? We will have to one day see & find out. This procedure all it does is force a law into a courtroom. Theres no voting it's an argument that the law is a danger to the public & either needs to be removed or changed. When it gets to the courtroom stage the people have a lot more leeway to argue something is a danger to the public. Only there everything said in court has to be considered & just can't be claimed as petty rhetoric. It also puts the media spotlight on the gov if we ever invoked it properly believe me the US would be on international news & the pressure would be on.
